Conditions of Delivery

Business Express shall not be liable to loss, damage, delay or destruction because of riots, strikes, Acts of God, the Queen’s or Public Enemies, Act or Default of the Owner or Shipper of the goods, nuclear reaction, radiation or radioactive contamination.

Business Express shall not be liable for any special, consequential or other damages in the delivery of a shipment, regardless of the cause of such delay.

No delivery times are guaranteed.

All fragile items (ie: glassware, ceramics, perishables, flowers, food) are shipped at the owner’s risk only.  Business Express will not be liable for any damage or loss however caused.

Unless otherwise duly noted on the Bill of Lading, the Consignee’s signature shall constitute receipt of the shipment in good order.

Business Express liability, in any event, shall not exceed CDN $2.00 per pound computed on the total weight of the shipment and is covered by the regulations in force in the jurisdiction at the time and place of shipment and is subject to the conditions set out in such regulations.  In the event no such regulations exist, it shall be governed by the Public Commercial Vehicles Act. R.S.O. 1980.

All damage claims must be made within 21 days from the date of receipt of the shipment.

All claims for non-delivery must be made within 30 days from the date of acceptance of the shipment.

All claims for concealed damage must be made within 24 hours from the time of delivery.

Payment Terms

Business Express bills on a bi-weekly basis and all freight charges are prepaid unless otherwise indicated. Payment terms are upon receipt of invoice.  All overdue accounts are subject to a service charge of 1.5% per month.
